Ordering Terms, Policies, and Conditions

1. PAYMENT POLICY / TERMS & ORDER PROCESSING:
A. Acceptable Currencies: HYREL LLC, (HYREL) accepts payments in United States Dollars (USD). Requests to pay HYREL with other currencies must be submitted in writing to HYREL for HYREL to determine acceptance of payment before purchase. Submittal of currency difference request does not guarantee acceptance.
B. Full Payments: HYREL accepts full payments before shipment of merchandise. Full payments (Business & Personal) can be made via cheque, credit cards via PayPal & Square, wire transfers, and cash. All full payment cancellations & refunds are subject to HYREL’s Order Cancellation & Refund Policy (Article 3).
C. Terms: HYREL reserves the right to grant or remove terms to customers.
i. North America: unless otherwise specified, NET 30 terms apply to all North American locations.
ii. Europe: European customers who require terms longer than 15 days must use our European distributor, Buero-Barth.
iii. Asia, Africa, Australia, Central & South America, and Oceania: Customers residing in Asia, Africa, Australia, Central & South America, and Oceania will be granted terms on a case-by-case basis only. Any company requiring more than 30 day terms are only accepted on a case-by-case basis. NET 45+ are completely unacceptable.
D. Deposits / Order Balances: HYREL is accepting deposits to lock-in production slots. The deposit amount to lock-in a production slot is 10% (ten percent) of the purchase price. A PayPal invoice for the deposit of 10% of the purchase price will be due upon order placement. The deposit will be applied toward the full purchase price of a HYREL 3D Printer, specified in your order.When production is within 4 (four) weeks of shipping, HYREL will contact you for the balance of your order, which is equal to the purchase price, minus the initial 10% deposit, plus shipping and handling. - The balance of your order is due 3 (three) weeks prior to shipment. If the balance of your order is not rendered 2 (two) weeks prior to scheduled shipment, your production slot will be assigned to the next customer in line. In the event this happens, you will receive a new ship date containing the next available production slot.
- If paying by Check, the balance of your order must be cleared to be considered rendered.
- Your deposit is subject to HYREL’s Deposit Cancellation & Refund Policy (Article 2). When the balance of your order is paid, your deposit becomes an order, which is subject to HYREL’s Order
- Cancellation & Refund Policy (Article 3). When your order is shipped, it is subject to HYREL’s Returns Policy (Article 4).
E. Collections: Upon non-payment (day 90), HYREL reserves the right to send non-payment of an order through a collections agency of HYREL’s choice.
2. DEPOSIT CANCELLATION & REFUND POLICY:
Deposits may be cancelled up to 3 (three) weeks prior to the first assigned scheduled ship date for a full refund. After which, a $250 USD processing fee will be collected from the deposit amount. If the $250 USD processing fee is more than the deposit amount, the full deposit amount will be collected; no other amount will be billed to the customer (you). In the event the balance of your order for the HYREL product is not paid in full within 6 (six) months of the initial deposit date, the initial deposit amount minus the $250 processing fee will be refunded via PayPal to the initial customer’s email account and the deposit and potential order will be canceled. In the case of a check, HYREL LLC will issue a check and send it to the original customer’s address, from whence the initial deposited check came.HYREL LLC reserves the right to cancel your deposit and refund your money at any time. When the balance of your order for the HYREL product is rendered and cleared, the deposit becomes an order and is subject to HYREL’s Order Cancellation & Refund Policy (Article 3).
3. ORDER CANCELLATION & REFUND POLICY:
Orders may be cancelled during the 3 (three) week period before the final scheduled ship date; however, orders cancelled during this time period are subject to an additional 10% processing charge, on top of the deposit cancellation processing fee, against the balance of your order. If the customer paid using PayPal, the adjusted amount will be paid back using PayPal. If the customer paid using a check, the adjusted amount will be returned using a HYREL issued check. HYREL LLC reserves the right to cancel your order and refund your money at any time. If the order is cancelled between the ship date and the delivery date, it is subject to HYREL’s Returns Policy (Article 4).
4. RETURNS POLICY:
It is our goal to make sure you get the product you’re looking for, even if it is not ours. Therefore, in the unfortunate event you so choose to return any of our products, please refer to the returns policy below.As long as the HYREL 3D Printer unit(s) ordered is returned in excellent condition with all parts intact and working, we will issue the original customer a refund up to a maximum of 75% (seventy-five percent) of your purchase price. Damages of any type to the unit(s) will be subject to review and may lower the refunded amount. The refunded amount can only be issued back to the original owner/purchaser of the HYREL 3D Printer, and will be returned in the manner of payment they were received (PayPal, Check, etc). This returns policy will be honored for the first 30 (thirty) days after shipment. The customer is responsible for all shipping and handling charges, taxes, and duties – no exceptions.
5. WARRANTY POLICY:
All core Electronics are covered for 1 (one) year. Installing/flashing any third party firmware onto any of electronics and/or tampering with any of the core electronics immediately voids any and all warranty.All Mechanical parts are under warranty for 90 (ninety) days. Operating any HYREL 3D Printer in a very dirty environment will void any and all warranty (for example: a saw mill or sand blasting area).
Heaters, hot ends and hot beds are covered for 90 (ninety) days, but if there is an obvious manufacturing error, we will not charge for repair.
Our policy for all parts (not just electronics) is depot repair; you (the customer) only pay shipping on warranty repairs.
6. SHIPMENT POLICY:
A. Domestic US Shipments are all shipments which are shipped within the 48 (forty-eight) continental states, including the District of Columbia.
B. Alaska, Hawaii, and other US territories are considered to be International Shipments.
C. International Shipments are all shipments which are shipped outside the 48 continental states, including the District of Columbia.
D. All international shipments, which are subject to, but not limited by the following: import & export tariffs, any and all taxes (ie, value added tax (VAT), general excise tax (GET), goods and services tax (GST), harmonized sales tax (HST), etc.), custom charges and duties, etc. and are the sole responsibility of the end customer – no exceptions.
E. Shipping Insurance is added to all domestic shipments.
F. Shipping Insurance is added to all international shipments, unless otherwise notified prior to HYREL receiving your (the customer’s) purchase order. This policy does not cover merchandise shipped on your (the customer’s) shipping account(s). In that case, all shipping insurance is the customer’s sole responsibility.
G. HYREL currently uses the United States Parcel Service (USPS), United Parcel Service (UPS), Federal Express (FedEx), and/or DHL to ship our products worldwide. If the customer has a preferred carrier and account on file with that carrier even if it is not with USPS, UPS, FedEx, or DHL, we will work with your preferred carrier on request.
H. We wish we lived in a perfect world where all governments worked together, unfortunately that is not the case. HYREL cannot and will not ship any product to any international country with which the United States government has embargos and/or sanctions levied against.
I. It is your responsibility to determine if your country and port-of-entry will allow any of HYREL’s products to be imported.
J. We strongly recommend you request us to have your shipment with arrive with signature required. However, we will not require this for domestic or international shipments.
7. LIMITATION OF LIABILITY:
Except where prohibited by law, in no event will HYREL be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if HYREL has been advised of the possibility of such damages.If, notwithstanding the other provisions of these policies, HYREL is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of our Products or any Content, HYREL’s liability shall in no event exceed the greater of, but not including (1) the purchase price for any HYREL hardware or software products or any HYREL support or similar support program, or (2) $100.00 USD. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.
You agree to indemnify and hold HYREL LLC, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against HYREL LLC by any third party due to or arising out of or in connection with your use of any of our products.
HYREL DOES NOT PROMISE THAT THE PRODUCT OR ANY CONTENT, SERVICE OR FEATURE OF THE PRODUCTS WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE PRODUCTS WILL PROVIDE SPECIFIC RESULTS. THE PRODUCTS AND ITS CONTENT ARE DELIVERED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. ALL INFORMATION PROVIDED ON THE PRODUCT IS SUBJECT TO CHANGE WITHOUT NOTICE. HYREL CANNOT ENSURE THAT ANY FILES OR OTHER DATA YOU LOAD ONTO THE PRODUCTS WILL BE FREE OF VIRUSES OR CONTAMINATION OR DESTRUCTIVE FEATURES. HYREL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANT-ABILITY AND FITNESS FOR A PARTICULAR PURPOSE. HYREL DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTIES IN CONNECTION WITH OR RELATED TO YOUR USE OF THE PRODUCT AND/OR ANY HYREL SERVICES. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE PRODUCTS AND ANY ACCESSORIES. YOUR SOLE REMEDY AGAINST HYREL FOR DISSATISFACTION WITH THE PRODUCTS OR ANY CONTENT IS TO STOP USING THE PRODUCT OR ANY SUCH CONTENT. SEE THE RETURN POLICY FOR FURTHER DETAILS. THIS LIMITATION OF RELIEF IS A PART OF THE BARGAIN BETWEEN THE PARTIES.
The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.
HYREL reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Products, or any portion of the Products, for any reason; (2) to modify or change the Products, or any portion of the Products, and any applicable policies or terms; and (3) to interrupt the operation of the Products, or any portion of the Product, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
